PROFESSIONAL EDITING & ADDITIONAL SIGNATURE RETOUCHING SERVICES
As mentioned in the Level of Service, all collections include Professional Editing. Professional Editing includes corrections to exposure, color balance, density, contrast, and minor/light blemish retouching. Additionally, all albums will undergo both Professional Editing and Signature Artistic Retouching.
Signature Artistic Retouching consists, but is not limited to skin smoothing, eye and teeth whitening, removal of distractions, tan lines, and overall sharpening and other enhancements.
Client(s) acknowledge that some retouching is beyond the scope of Signature Artistic Retouching and that decision is left to the discretion of the Photographer. If Client(s) does not wish to purchase an album or other product that includes retouching, Signature Artistic Retouching for digital negatives can be purchased at an hourly rate of $75.
IMAGE DELIVERY & ARCHIVAL
Betsy Wall Photography will deliver digital negatives of hand selected images to the Client(s) within 3 weeks following the completion of services. Upon delivery, the Client(s) will be fully responsible for the safekeeping of the negatives. Betsy Wall Photography does not guarantee a permanent archival of your images. Upon your receipt of these digital files, you hereby release Betsy Wall Photography from all responsibility and liability to archive your images. It is recommended to back up your images in multiple places, such as a hard drive and online cloud storage, for safe keeping.
IMAGE USE & COPYRIGHTS
The photographs, digital negatives or prints produced by Betsy Wall Photography are protected by U.S. Copyright Law (all rights reserved) and may not be reproduced in any manner without Photographer’s explicit written permission. Upon final payment by Client(s), limited usage rights of the resulting images will be transferred to Client(s) under the following conditions:
The negatives and/or slides are the property of Client(s) for personal use and for the purposes of the reproduction and distribution of photographs to friends and relatives.
Client(s) must obtain written permission from, and compensate Betsy Wall Photography prior to an event where Client(s), Client’s friends, relatives or anyone else publish or sell the photographs for profit.
Images may be used on personal web sites as long as a copyright notice appears near the images stating that they were taken by Betsy Wall Photography, images are not altered or compromised in any form, and a web link to http://www.betsywall.com is to be placed onto the posting web site.
LIMITATION OF LIABILITY
Betsy Wall Photography will make every reasonable effort to produce and deliver outstanding photographs. The entire liability to Client(s) for claim, loss, or injury relating to this Agreement will be a refund to Client(s) of the amount paid for its services less the value of the services provided. For example, if Photographer’s equipment experiences a failure and Photographer only captures 50% of the event, Photographer could be held liable to refund 50% of the total amount paid to Photographer, but no more.
COOPERATION
Client(s) is responsible for good conduct. Betsy Wall Photography will not tolerate verbally or physically abusive behavior. If clients engage in conduct that is unreasonably harassing or dangerous to employees of Betsy Wall Photography or otherwise unreasonably prevents the completion of the services described here, Betsy Photography has the right to terminate this Agreement and depart the photography location immediately. In such an event, Client(s) will not be entitled to any refund and Betsy Wall Photography is excused from its remaining obligations under this Agreement. If Client(s), Client’s guests, or any other service providers hired by Client(s) intentionally or unintentionally damage equipment belonging to Photographer, Client(s) will be liable to Photographer for the full costs of replacement.
PROOFING & ORDERING
After your session you will receive an online gallery of your images. If you purchase additional items payment is due upon order. Your online gallery will expire after 3 months. There is a $45 charge to upload your gallery for an extra month.
Be sure to inspect your images very carefully in your gallery, before any order is made. Once images and products are ordered, all sales are final.
Creative privilege - there are times when an image needs a certain crop or a particular treatment. While Betsy Wall Photography will try to match your taste, I need to have freedom to decide how to make an image look its absolute best, and to retain my signature style.
Design work or processing orders is not done until payment is complete.
If you have a request for a small change to an image, please let Betsy Wall Photography know before any product orders are placed. I can address minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests are billed at additional signature retouching rate (stated above in RETOUCHING). You will be notified if there will be extra charges before work is begun. Once the requested changes are made, charges apply regardless if the final product is purchased.
Detailed printing instructions will be provided with your images. Your images will be cropped and colored how I believe they will print the best. If you crop an image in too tightly, you will lose resolution and may cause it to be pixilated when enlarged. To ensure the best print quality, avoid altering your images before printing. Betsy Wall Photography is not responsible for printing errors or for quality of prints or products not purchased through my studio.
Checks returned by the bank for any reason will be charged a $25.00 service charge and sessions/orders will be cancelled if they are not paid in full within three days of notification.
Betsy Wall retains copyrights on all images and reserves the right to use the images and/or reproductions for display, publication, or other purposes. “All rights” pricing is available upon request. Under no circumstances can a client use these images for profit, commercial endeavors, in competitions, or for professional display.
Do not copy images you have not purchased. Copying or scanning images from your gallery, our website, the blog, or from other printed materials is considered stealing, regardless of the intent for use.
Do not alter, modify or edit the photographs in any way except for basic cropping as related to printing and display. Any unauthorized modifications made to photographs will be considered copyright infringement and may be actionable by law.
Credits and special offers are non-transferable and are not redeemable for cash.
A new session cannot be scheduled until ordering is complete on past sessions.
